法律翻譯模糊詞語翻譯方法
法律翻譯有多難，只有從事專業(yè)法律翻譯的人才知道。首先法律翻譯要準確、精準，但是遇到一些模糊概念的詞怎么辦？下面一些方法可供參考。
第一、變異譯法
有時，一種語言中用一個詞表達模糊概念，可在翻譯時卻用另一種語言的非對等詞來表達相同的模糊概念，這就是模糊變異譯法。在法律英語中，有時出現具有虛指作用的數詞，這時可采用此法翻譯，例如：
The state constitution provides that it is lawful for the citizens to carry guns. In recent years hundreds and hundreds of innocent people have died of this and one need not look for a lesson.
該州憲法規(guī)定，公民攜帶槍支是合法的，正因為如此，最近幾年成千上萬的無辜的人慘遭身亡，教訓歷歷在目。
Hundred and hundreds of 的意思是“幾百”，這里譯作“成千上萬”，這里模糊變異譯法。
第二、省略法
Mr. Justice Douglas rejected the death penalty because it was administered in such a way as to discriminate against unpopular minorities.
大的法官道格拉斯先生則是由于執(zhí)行死刑的方式方法歧視不得人心的少數人所以才反對死刑。
Such 在英語中是個模糊詞語，意思是“這樣的”，這里沒有翻譯出來。
第三、對等譯法
語義雖然存在模糊性，而且英漢兩種語言中詞語的模糊性也不盡相同，但這并不妨礙這兩種不同語言之間的直譯。事實上，在有些情況下，尤其是在法律文件起草人可能是有意使.用模糊詞語時，我們可以采取模糊對等翻譯，即用一種語言的模糊詞語去翻譯另一種語言的模糊詞語。例如：
“We the people of the United States, in order to form a more perfect union establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.”
“我們合眾國的人民，為了組建一個更為完善的聯(lián)邦；樹立公正；保障國內安寧；建立共同的國防；增進一般福利；以及為我們自己和我們的后代確保自由的賜福；特為美利堅合眾國制定并確立本憲法?！?
英語中的“perfect”，“common”，“general”三個模糊詞語，譯成“完善的”、“共同的”、“一般的”。
If a sentence of imprisonment is imposed, there are limits on the term of imprisonment — not more than six months or less than three years.
如對之作出徒刑判決，其刑期也有限制 —— 或不超過六個月或少于三年。英語中的“no more than”和漢語中的“不超過”，“l(fā)ess than”和“少于”可謂模糊對模糊。
It was reported by the police that murderer was thin and gaunt with deep 6 wrinkles in the back of his neck.
據警方報道，該殺人犯又瘦又憔悴，后頸上有很深的皺紋。
這個句子中有三個英語模糊詞“thin”，“gaunt”和“deep”，可把它們相應譯成三個漢語模糊詞“瘦”、“憔悴”和“深”，這是模糊對等譯法。
