大家都知道法律是不可觸碰的，那法律的嚴謹性也是極其高，在國際交流密切的時代少不了法律翻譯的需求，那法律翻譯就講究嚴謹和準確性，這是法律翻譯必須要達到的，法律翻譯必定會用到法律專業(yè)術語，但不排除經常會有一些模糊詞的出現(xiàn)，那對于模糊詞又該作何翻譯，其實這些模糊詞往往表現(xiàn)在語義中，一般采用如下幾種方法：
法律翻譯方法一：對等譯法
語義雖然存在模糊性，而且英漢兩種語言中詞語的模糊性也不盡相同，但這并不妨礙這兩種不同語言之間的直譯。事實上，在有些情況下，尤其是在法律文件起草人可能是有意使用模糊詞語時，我們可以采取模糊對等翻譯，即用一種語言的模糊詞語去翻譯另一種語言的模糊詞語。
“We the people of the United States， in order to form a more perfect union， establish justice， insure domestic tranquility， provide for the common defense， promote the general welfare， and secure the blessings of liberty to ourselves and our posterity， do ordain and establish this Constitution for the United States of America.”
“我們合眾國的人民，為了組建一個更為完善的聯(lián)邦；樹立公正；保障國內安寧；建立共同的國防；增進一般福利；以及為我們自己和我們的后代確保自由的賜福；特為美利堅合眾國制定并確立本憲法?！?br />
英語中的“perfect”，“common”，“general”三個模糊詞語，譯成“完善的”、“共同的”、“一般的”。
If a sentence of imprisonment is imposed， there are limits on the term of imprisonment — not more than six months or less than three years.
如對之作出徒刑判決，其刑期也有限制 —— 或不超過六個月或少于三年。
英語中的“no more than”和漢語中的“不超過”，“l(fā)ess than”和“少于”可謂模糊對模糊。
It was reported by the police that murderer was thin and gaunt with deep wrinkles in the back of his neck.
據警方報道，該殺人犯又瘦又憔悴，后頸上有很深的皺紋。
這個句子中有三個英語模糊詞“thin”，“gaunt”和“deep”，可把它們相應譯成三個漢語模糊詞“瘦”、“憔悴”和“深”，這是模糊對等譯法。
法律翻譯方法二：增詞法
所謂“增詞法”，就是指根據原文的精神實質，為使譯文更忠實通順地表達原文的思想內容，而增加適當?shù)哪：~語，而不是機械地保持原文與譯文之間的詞量上的對等。
A proposal for concluding a contract addressed to one or more specific persons constitutes an offer if it is sufficiently definite and indicates the intention of the offer or to be bound in case of acceptance.
向一個或一個以上特定的人提出的訂立合同的建議，如果十分確定并且表明發(fā)價人在得到接受時承受約束的意旨即構成發(fā)價。
原文中并沒有“十分”，筆者依據其精神實質，增譯了表達模糊概念的數(shù)量詞“十分”。
The procuration of women and girls for purposes of prostitution， and the causing and encouraging of such persons to prostitute themselves， are offences punishable by terms of imprisonment.
介紹婦女為娼以及致使并鼓勵婦女賣淫均為犯罪，應判刑期不等的徒刑。
譯文中增添了具有模糊語義的詞組“不等”。
法律翻譯方法三：變異譯法
有時，一種語言中用一個詞表達模糊概念，可在翻譯時卻用另一種語言的非對等詞來表達相同的模糊概念，這就是模糊變異譯法。在法律英語中，有時出現(xiàn)具有虛指作用的數(shù)詞，這時可采用此法翻譯。
The state constitution provides that it is lawful for the citizens to carry guns. In recent years hundreds and hundreds of innocent people have died of this and one need not look for a lesson.
該州憲法規(guī)定，公民攜帶槍支是合法的，正因為如此，最近幾年成千上萬的無辜的人慘遭身亡，教訓歷歷在目。
Hundred and hundreds of 的意思是“幾百”，這里譯作“成千上萬”，這里模糊變異譯法。
法律翻譯方法四：省略法
Mr. Justice Douglas rejected the death penalty because it was administered in such a way as to discriminate against unpopular minorities.
大法官道格拉斯先生則是由于執(zhí)行死刑的方式方法歧視不得人心的少數(shù)人所以才反對死刑的。
Such 在英語中是個模糊詞語，意思是“這樣的”，這里沒有翻譯出來。
法律翻譯方法五：具體問題具體分析
翻譯就是用一種語言來表達已用另一種語言表達出來和思想，它涉及的兩個方面就是對一種語言的正確理解和用另一種語言來準確的表達。由于英漢兩種語言的差異所在，有時候可以在不影響理解的基礎上，靈活處理。比如，在一種語言中用的是語義精確的表達式，而在翻譯時卻可根據具體情況，譯為模糊詞語，即化精確為模糊。反之，原文中用模糊的表達式，翻譯時卻可化模糊為精確。這種方法在法律英語翻譯中同樣適用。
It is two and two makes four that the corporal punishment administered by the defendant was minimal， and not excessive.
很明顯，被告所施加的體罰屬最低限度而并未過當。
“two and two makes four”是確切詞語，這里譯作模糊詞語“很明顯”。
Conditions of probation may be imposed on the offender if the court considers them necessary for securing his good conduct or for preventing a repetition of the offences and the commission of further offences.
法院認為為了保證罪犯循規(guī)蹈矩或防止其再犯或重新犯罪，必要時得對罪犯規(guī)定假釋的條件。
“good conduct （好的行為）”算是一個模糊詞語，這里用一個漢語成語“循規(guī)蹈矩”來翻譯，可謂靈活處理了。
以上幾種方法僅供參考，法律翻譯的準確性是不可忽視的，所以遇到模糊詞，要根據上下文，進行反復推敲，使得譯文得體又不失準確。
